In an intriguing turn of events, Dr. Olufemi Olaleye, the Medical Director of Optimal Cancer Care Foundation in Lagos, has launched an appeal against a life imprisonment sentence meted out for his alleged involvement in a sexual assault case. The conviction was handed down by Justice Rahman Oshodi of the Ikeja Sexual Offenses and Domestic Violence Court on October 24, under the charge ID/20289C/2022.

Dr. Olaleye was accused of defiling his wife's niece who claimed to be 16 years old. The accusation led to a high-profile trial that ended in a conviction, much to the shock of Olaleye and his legal team. The initial ruling stirred waves of concern and debate within legal circles and the wider public, setting the stage for a contentious appeal process.

Grounds for Appeal

On November 24, Olaleye's legal representative, Dr. Kemi Pinheiro, SAN, filed a notice of appeal at the Court of Appeal in Lagos State, presenting an elaborate 35 grounds for overturning the conviction. The appeal is based on several contentions, key among them being the lower court's decision to proceed without requiring direct evidence of the victim's age, such as a birth certificate.

Dr. Pinheiro also took issue with the perceived inconsistencies in the testimonies provided during the trial. He notably challenges the credibility of the prosecution witnesses, which included the testimony of the victim, Olaleye's wife, and medical evidence from Dr. Akinbunmi Oyebimpe. According to Pinheiro, the medical evidence presented contradicts the timeline of the alleged assault, further casting doubt on the validity of the conviction.

Pinheiro is seeking four reliefs from the appellate court, including setting aside the lower court's decision, quashing the conviction and sentence, and discharging and acquitting Olaleye.
